These terms govern your use of solareclipseglasses.co (the “Shop”) and the purchases you make through it. By using the Shop or placing an order, you accept these terms. They do not limit any rights that cannot lawfully be excluded.

In these terms, “we”, “us” and “our” mean Rezos LLC, 3500 S Dupont Hwy, STE 300, Dover, DE 19901, USA, the Shop operator, seller and manufacturer. The products are sold under the Tember brand. The EU importer/distributor is Nacnic Estudio SL, Terminillo 57-59 Local, 50017 Zaragoza, Spain.

Using the Shop and accounts

You must provide accurate, current information and use the Shop only lawfully. You are responsible for protecting your login details and for activity authorised through your account. You must not interfere with the Shop’s security, misuse its content, introduce malicious code, extract data in a way that disrupts the service, or infringe the rights of others.

Products and safe use

We aim to describe and show products accurately, but colours and appearance can vary between screens and minor, immaterial differences may occur. Follow all instructions and warnings supplied with the product. Inspect eclipse-viewing products before every use and do not use a damaged product. Children may use them only under adult supervision. Do not use a product with cameras, telescopes, binoculars or other optical devices unless it is expressly intended and described for that purpose.

Orders, prices and availability

Products, availability and promotions may change. The price, applicable taxes, shipping charges and total are shown before you submit your order. An order acknowledgement only confirms that we have received your request; it does not prevent us from cancelling an order because of a genuine pricing or description error, lack of stock, suspected fraud, unlawful activity, impossible delivery or another legitimate reason. If we cancel after payment, the amount concerned is refunded in a legally appropriate way.

Payment and delivery

The payment methods available to you are shown at checkout. You confirm that you are authorised to use the payment method you choose. Delivery options, charges, estimates, delays and damage in transit are covered by our Shipping Policy.

Returns, faults and statutory rights

Cancellations, returns, refunds, return-shipping costs and damaged or faulty products are covered by our Refund Policy. These policies add to, and do not replace, mandatory consumer guarantees and remedies.

Intellectual property and third-party services

Text, graphics, trademarks, photographs and other Shop content belong to us or are used with permission and are protected by law. You may use the Shop to make personal purchases, but you may not copy or commercially exploit its content without permission. The Shop may use or link to third-party services. Their own terms and privacy practices may apply, and we are not responsible for third-party sites we do not control.

Liability

To the extent permitted by law, we are not liable for losses that were not reasonably foreseeable, for losses caused by events outside our reasonable control, or for business losses arising from consumer use. We do not exclude or limit liability where it would be unlawful to do so, including for fraud, wilful misconduct, or death or personal injury caused by negligence. Mandatory product-safety and consumer rights are not limited.

Governing law, changes and contact

The applicable law and competent courts are determined by mandatory consumer-protection and conflict-of-laws rules. As a consumer, you keep the mandatory protection of the law of your country of residence, where applicable.
